Welcome to Black Car Service NYC (“BKNY”), a premier licensed livery service dedicated to providing exceptional transportation solutions. By accessing and using the BKNY website located at blackcarservicenyc.us, and by requesting, purchasing, or booking services through our platform, you (the “Client”) are agreeing to be bound by the following terms of service (the “Terms”), alongside our website acceptable use policy (“AUP”) and privacy policy (“PP”), which are available at our privacy policy page. Please read these terms carefully as they form a binding legal agreement between you and BKNY.
Rates, Fees, and Surcharges
- Base Fares: All services are subject to a fuel charge of 7% applied to the base fare. For hourly reservations, billing starts from the time the vehicle departs the BKNY facility until its return, with a minimum booking time as stated.
- Gratuity: A mandatory 20% gratuity for the chauffeur is automatically added to the base fare for all services.
- Wait Time: BKNY implements charges for wait time beyond the grace period at a rate specified in the terms, applicable to different types of reservations.
- Limousines or Buses: Additional out-of-pocket charges for services involving limousines or buses will be detailed on the invoice, including tolls, parking, and airport fees.
- Airport Surcharge: Additional fees apply for airport greeter services and late-night airport pickups within specified hours.
- Cancellation: Cancellations must adhere to the specified timeframe to avoid a cancellation fee, which includes the full fare, gratuity, and any incurred costs.
- Referral Fees: In situations where BKNY subcontracts to affiliated companies, additional policies may apply.
- Billing: All charges are billed to the Client’s credit card on file following service completion or in accordance with our cancellation policy. BKNY accepts major credit cards.
- No-Show Fees: Fees apply when a passenger fails to show at the designated location, calculated as detailed in the terms.
- Holidays: A holiday surcharge is applied to services on designated public holidays.
- Additional Terms for Events Services: Special terms apply for event-related transportation services, including billing and minimum booking times.
Damage to Vehicle
Clients are responsible for any damage caused to BKNY vehicles or property by themselves or their party during the use of our services. Charges for damages and cleaning are specified within these terms.
Best Efforts and Limit of Liability
BKNY commits to using its best efforts to provide services as requested. However, we are not liable for service failures or delays caused by factors beyond our reasonable control. This includes, but is not limited to, weather conditions, road conditions, and vehicle breakdowns.
Client Behavior
BKNY reserves the right to ensure a safe and respectful environment for both our clients and drivers. Inappropriate behavior, including smoking, alcohol consumption, or failure to comply with driver requests, may result in service termination.
Website Acceptable Use Policy
Our AUP outlines prohibited actions such as hacking, spreading viruses, network attacks, spamming, and intellectual property infringement. Violations may result in account suspension or legal action.
Modifications to Terms and AUP
BKNY reserves the right to modify these Terms and the AUP at any time. Changes will be effective immediately upon posting on our website. Clients are encouraged to review these documents periodically.
Acceptance of Terms
By using BKNY’s services and website, you acknowledge and accept these Terms of Service, including our AUP and PP. Your continued use of our services following any updates signifies your agreement to the revised terms.
